How long does it take to receive requested records?
-
CPFR must acknowledge a public records request within five business days. The acknowledgement may be to provide the requested records, but may also be to indicate a timeframe within which CPFR may reasonably fulfill the request.
RCW 42.56.520 provides that a response to a request for public records must be made within five (5) business days after receiving a request. Weekends and observed holidays by CPFR are excluded in the calculation.
-
Why does the requested record have redactions?
-
While the State of Washington strongly encourages disclosure of public records, state law does allow for some information to be withheld. These exemptions are listed in the Public Records Act (RCW 42.56). Other exemptions are found elsewhere in Washington law, and in Federal law.
Many of the exemptions are designed to protect the privacy rights of other individuals. Other exemptions are designed to protect investigative functions of law enforcement and other agencies with investigative responsibilities, as well as the legitimate business interests of other citizens.
If the requested records contain redactions or are withheld due to exemptions, the applicable RCW or other law will be referenced as the reason for redaction/withholding.
-
How will the requested record be provided to me?
-
The preferred method of providing public records is via email. By request, records may also be mailed, faxed, or observed in person at the CPFR Administrative & Operations Center during normal business hours.
-
Are public records requests confidential?
-
No. Once CPFR receives a public records request, the request itself becomes a public record of CPFR. A request may be made for that document, which would be provided to the requestor.
-
Can I submit a request anonymously?
-
CPFR will need contact information to communicate with you about your request. The amount of personal data you submit beyond that will be at your discretion.
-
What is third party notification?
-
If records contain information that may affect others and may be exempt from disclosure, CPFR may send a notice to those parties informing them of the request prior to providing records to the requestor.
-
What are the fees associated with processing public records?
-
There is no fee for processing public records requests if records are sent via email. If hardcopy public records are requested, the fee is $0.17 ($0.26 for color) per page after the first 10 pages. There is a $5 fee for delivery of records on a CD.
